This Refund and Return Policy explains the conditions under which withVR BV provides refunds for Therapy withVR subscriptions, how to request a refund, and what happens to your data when a subscription ends. It applies to all purchases made through withvr.app.
This policy forms part of the withVR Terms of Service. Where this policy and the Terms of Service address the same topic, this policy provides the more detailed treatment. Nothing in this policy limits your statutory rights under Belgian law or applicable EU consumer protection legislation.
1. Digital Products - No Physical Returns
Therapy withVR is a digital software platform. All products and services are delivered electronically. There are no physical goods associated with a Therapy withVR subscription, and accordingly no physical return process applies.
All refund and dispute matters are handled under the refund policy set out in this document.
2. EU Statutory Withdrawal Right
If you are a consumer purchasing a digital service from within the EU or Belgium, you have a statutory 14-day right of withdrawal from the date of purchase under the EU Consumer Rights Directive (2011/83/EU) and Belgian implementing law (Book VI of the Code of Economic Law).
By completing your purchase and requesting immediate access to the Therapy withVR platform, you expressly consent to the immediate provision of the digital service and acknowledge that you lose your right of withdrawal once the service has begun to be performed. This waiver is presented at checkout before payment is completed.
If you do not wish to waive this right, you must not request immediate access to the platform at checkout. Contact hello@withvr.app before completing your purchase if you wish to discuss this.
Business customers: The statutory right of withdrawal does not apply to purchases made by business customers purchasing on behalf of an organization. If you have entered a company name, VAT number, or organization details at checkout, you are purchasing as a business customer. |
3. Subscription Cancellation
You may cancel your Therapy withVR subscription at any time. Cancellation takes effect at the end of your current paid billing period - you retain full access to the platform until that date.
To cancel your subscription, contact hello@withvr.app with your account email address.
Cancellation does not automatically trigger a refund of the current period’s subscription fee. Refund eligibility is governed by Section 4. Your data is retained after cancellation in accordance with the Privacy Policy and Section 7 of this document.
If you need to temporarily stop using the Platform rather than cancel (for example, due to parental leave, sabbatical, or institutional budget constraints), you may request a subscription pause instead. See the Terms of Service for details, or contact hello@withvr.app.
4. Refund Eligibility
Therapy withVR subscriptions are generally non-refundable once the service has been accessed, in accordance with the EU Consumer Rights Directive provision for digital content delivered with prior consent. However, withVR BV will consider refund requests in the following circumstances:

General position: Refunds are not provided for change of mind, underuse of the subscription, or dissatisfaction with the platform's suitability for a particular use case. The platform's features and scope are described at withvr.app before purchase. |
5. How to Request a Refund
To request a refund, contact support@withvr.app within 30 days of the charge in question. Please include:
- Your account email address
- The date and amount of the charge
- A description of the reason for the refund request
- Any supporting documentation (for example, screenshots of a technical issue or confirmation of a cancellation request)
withVR BV will acknowledge your request within 5 business days and communicate a decision within 10 business days of receiving all necessary information. Approved refunds are processed to the original payment method where possible. For payments made via Stripe (including card and PayPal), refunds are issued through Stripe. For payments made by bank transfer, refunds are issued to the originating bank account. The time for the refund to appear in your account depends on your payment provider, typically 5 to 10 business days after processing.
6. Payment Disputes and Chargebacks
Payments may be processed by Stripe (including card and PayPal) or by direct bank transfer. If you believe a charge is incorrect or unauthorized, we strongly encourage you to contact support@withvr.app before initiating a chargeback with your bank or card issuer. Most billing issues can be resolved directly and more quickly through our support channel.
If you initiate a chargeback without first contacting withVR BV, we reserve the right to provide Stripe and your card issuer with transaction records and usage logs to demonstrate that the service was delivered as described. Chargebacks filed in cases where the service was demonstrably delivered and accessed may result in suspension of the associated account.
For payment disputes that cannot be resolved directly, Stripe's dispute resolution process is available in accordance with Stripe's terms. withVR BV will cooperate with any Stripe-mediated dispute process.
7. Your Data After Cancellation
When your subscription ends - whether through cancellation, non-renewal, or account closure - the following applies:

Data retention | Account and subscription data is retained for up to 5 years after subscription end. Session and profile data is retained for up to 3 years after subscription end. These periods allow you to reactivate your account and access previous session data if needed. For full details, see the Privacy Policy. |
Data export | You may request a full data export at any time during an active subscription, or within the retention window after cancellation, by contacting hello@withvr.app. Exports are provided within 30 days of request. |
Data deletion | You may request deletion of your personal data at any time by contacting legal@withvr.app. Deletion requests are fulfilled within 30 days, except where retention is required by applicable law (for example, billing records are retained for 7 years under Belgian accounting law). |
Reactivation | If you reactivate your subscription within the data retention window, your previous session data, profiles, and settings will be available. |
8. Free Trial
Therapy withVR may offer a free trial period for new accounts. No payment is required during the free trial, and no payment method is collected at sign-up. The trial does not automatically convert to a paid subscription. At the end of the trial period, access to the Platform is disabled unless you choose to purchase a subscription.
The trial period and its duration are communicated at the time the trial is offered. Trial availability and duration may vary.
9. Your Statutory Rights
Nothing in this policy limits your rights under applicable mandatory consumer protection law. In particular:
- Belgian consumers retain all rights under the Code of Economic Law (Wetboek Economisch Recht), including rights relating to unfair contract terms and defective digital services
- EU consumers retain rights under the EU Consumer Rights Directive (2011/83/EU) and the EU Digital Content Directive (2019/770/EU)
- UK consumers retain rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013
If you believe withVR BV has not honored your statutory rights, you may contact the Belgian consumer protection authority (the FPS Economy - economie.fgov.be) or your national consumer protection body. In the EU, the European Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.
10. Changes to This Policy
withVR BV may update this Refund and Return Policy from time to time. If we make material changes, we will notify existing users at least 30 days before the changes take effect, by email and/or in-Platform notification. The version number and effective date at the top of this document identify the version in force.
